Deck Builder Warranty in Sydney: What You’re Actually Covered For

Deck Builder Warranty in Sydney: What You’re Actually Covered For

By 5 Star Decking  ·  8 min read  ·  May 2026  ·  NSW Builder’s Licence 395250C

Most homeowners ask one question about warranty: “how long is it?” That’s the wrong question. The right questions are: who actually holds each warranty, what does NSW law already give you whether or not you negotiate for it, and what happens when a board fails and the supplier stops answering the phone.

Here’s the full picture — no marketing spin, no fine print buried at the end.

A Deck Has Three Separate Warranties — Not One

This is what almost nobody explains upfront, and it’s the source of most warranty confusion and disputes.

Layer 1 — NSW Statutory Warranties (Home Building Act 1989)

Automatically apply to ALL residential building work in NSW. You don’t negotiate for these — they exist by force of law. 6 years for major defects, 2 years for everything else. Held by the builder.

Layer 2 — Builder’s Workmanship Warranty

The builder’s own warranty on installation quality — framing, board-laying, balustrades, stairs. Sits on top of statutory protection. Held by the builder.

Layer 3 — Manufacturer Product Warranties

Issued by the company that made the boards, fixings, balustrade system. Pass through to you as the property owner. NOT held by the builder — held by the supplier. This is where most warranty disputes actually happen.

Most problems happen because clients assume one person holds all three. They don’t. A frame failure is the builder’s responsibility. A board that splits or fades is the manufacturer’s. Knowing which is which determines who you call — and who has to fix it.

Layer 1: What NSW Law Already Gives You

This is the warranty most Sydney homeowners don’t know they have — and the most important one.

Section 18B of the Home Building Act 1989 (NSW) sets statutory warranties that apply automatically to all residential building work — including decks — regardless of contract value and regardless of what the builder’s contract says. These cover:

  • Work performed in a proper and workmanlike manner
  • Materials used are good and suitable for purpose
  • Work complies with the Act, regulations and any other applicable law
  • Work completed with due diligence
  • The completed work is reasonably fit for its intended purpose

The statutory warranty period is 6 years for major defects and 2 years for all other defects, running from the date of completion.

✅ Key point: If a builder’s contract tries to limit your warranty below these thresholds, that limitation is void. NSW statutory protection applies regardless. A builder offering a “12-month warranty” doesn’t remove your 6-year rights under the Act.

One critical catch: under Section 18BA, if you discover a defect you must give the builder written notice within 6 months of becoming aware of it. Miss that window and you can lose the right to enforce the warranty — even if you’re still within the 6-year period. If something goes wrong, document it and notify in writing immediately.

Layer 2: The Builder’s Workmanship Warranty

This covers everything related to how the deck was built — not what it’s made of.

✅ What it covers

  • Frame defects — joist failure, ledger pulling away, inadequate bearer support
  • Board installation — fasteners loosening, gaps opening beyond normal movement, edges lifting
  • Stairs, balustrade and finishing component installation
  • Anything that fails because of how it was installed

❌ What it doesn’t cover

  • The materials themselves — that’s the manufacturer’s job
  • Impact damage, misuse, storm events
  • Normal weathering and wear (timber will silver, composite shows foot traffic)
  • Modifications by someone else after handover
  • Neglected maintenance (blocked drains, uncleared debris)

5 Star Decking’s workmanship warranty is 2 years on all builds, backed by the statutory framework above. We don’t dress it up with marketing language — the NSW Home Building Act already gives you the strongest protection available. Any builder advertising a “lifetime workmanship warranty” is either overselling or counting on never honouring it.

Layer 3: Manufacturer Warranties — The Layer That Catches People Out

This is where most real-world warranty disputes land — and where the fine print actually matters.

Every material on your deck carries its own manufacturer warranty, passed through to you as the property owner. The builder is the installer — not the warranty holder for the product itself.

Typical product warranty periods

  • Evalast Pioneer composite — 25 years structural, fade and stain included
  • Millboard — 10 years (enhanced grain range)
  • ModWood composite — 10 years structural
  • Spotted Gum / Blackbutt hardwood — durability is inherent (Class 1), supplier warranties vary
  • Marine-grade stainless fixings — typically 10–25 years depending on grade
  • Glass balustrade systems — varies by supplier, check at quote stage

The catch: a manufacturer warranty is only as strong as the manufacturer’s willingness to honour it. We’ve seen suppliers replace failing boards with a discontinued product in a different colour. We’ve seen suppliers go quiet for months. We’ve seen warranty claims dragged out until homeowners give up.

That’s why we are selective about which brands go on our builds. We only use products from manufacturers who have proven they back their warranties when claims come in — Evalast, Millboard, ModWood, and a small group of hardwood suppliers we’ve worked with for years. If a supplier can’t have a straight conversation about warranty before a single board goes down, they don’t go on our jobs.

The Right Questions to Ask Any Builder About Warranty

Don’t just ask “how long is your warranty?” Here’s what actually matters:

QuestionWhy it matters
What does NSW statutory warranty cover on this build?Tests whether they know the Home Building Act. Evasive answers are a red flag.
What does your workmanship warranty cover beyond statutory? If they’re charging extra for a “premium warranty,” it’s marketing — NSW law already covers most of it.
Which manufacturer warranties apply, and for how long?Composite, timber, fixings and balustrades all have separate coverage. You need the full picture.
Will you provide manufacturer warranty documents at handover?A good builder hands these over. A bad one disappears when a board fails.
Have you ever had to chase a manufacturer for a warranty claim?Tells you whether they understand the real-world warranty process — or are just quoting numbers.
What’s specifically NOT covered?Honest builders answer this readily. Defensive ones don’t.
